A TIKTOK influencer has been released from custody after a court was one minute too late to hear her case.
Fiona Ryan, also known as Fiona Elizabeth Buckingham, was arrested at 10.42am on Wednesday, April 24, after a video was uploaded to her TikTok account.
The 40-year-old, of Laverstock Road, was on conditional bail not to use any form of social media at all when the video was uploaded.
This followed four charges of malicious communications for allegedly posting grossly offensive videos on TikTok between March 4 and April 18 this year.
Ryan pleaded not guilty to all the charges at Swindon Magistrates' Court on Tuesday, April 23.
She was due to appear at Salisbury Magistrates Court on Thursday, April 25, to answer the bail breach but the case could not go ahead.
David Fosler, prosecuting, told the court at 10.43am: "It’s a charge of breach of bail, she was arrested at 10.42am yesterday so it means we are now a minute out of time."
After someone breaches their bail conditions, they must be presented to a magistrates' court within 24 hours of their arrest.
If no charges are made, they may be re-released on bail with the same or revised conditions, or they can be released without bail.
Mr Fosler recommended that the same conditions to not use social media and only use internet enabled devices for the purpose of internet banking, non-work emails and in relation to child care with schools were imposed.
Ayaz Iqbal, defending, said Ryan was going to contest the breach as she "always maintained that she didn't post anything on social media".
"It was family members who posted it. She won't be on social media, she hasn't breached her bail," added Mr Iqbal.
Mr Iqbal also asked the court to tell Wiltshire Police that Ryan's family members use the same account to which he was told it was not the court's responsibility.
"Clearly she’s quite well known on social media platform with tens of thousands of followers but I'm aware that family members also use her platform so I’m trying to prevent this from reoccurring," he said.
Ryan is due to appear at Salisbury Magistrates' Court on May 16 for her next hearing.
