A DISQUALIFIED driver has ended up in court after being spotted by police undertaking a vehicle.

Zakk Whiteley, who gave a care of address in Salisbury and was of no fixed address, admitted driving while disqualified on London Road, Shrewton and driving without insurance on June 18, 2021.

The 21-year-old appeared in custody at Salisbury Magistrates' Court on Tuesday January 4 after failing to answer a postal requisition to attend court.

The court heard that when the offence took place the defendant had come to the attention of police for an undertaking manoeuvre in his Honda CR-V, which had concerned officers.

He was stopped and arrested after refusing to provide his details. When he eventually did, he was found to be disqualified from driving and was the subject of a community order.

The defendant had received a driving ban for 18 months and a community order on September 1, 2020 for dangerous driving. 

William Griffiths, defending, said Whiteley had pleaded guilty at the earliest opportunity and that he had made a "foolish decision" to drive that day. He had been staying in Shrewton and was on his way to see his child.

Mr Griffiths also told the court that the defendant had not been progressing well with his current community order and communication links had broken down with the probation service because he did not have a phone. But he added the defendant had tried to contact probation and was re-establishing those links.

The court heard the former mechanic, who now works at Sainsbury's, had a number of hours of unpaid work still to complete.

Magistrates were asked by the probation service to revoke the community order and a new sentence was imposed.

Whiteley was given a prison sentence of 24 weeks, suspended for 18 months.

He was ordered to carry out 250 hours of unpaid work and must complete a rehabilitation activity requirement.

In addition to this he was disqualified from driving for a year and ordered to pay a surcharge of £128 and costs of £85.

Magistrates also ordered the forfeiture and destruction of Whiteley's Honda CR-V.

No separate penalty was given for driving without insurance.
